GENERAL TERMS & CONDITIONS OF STAY

1. INFORMATION

Accommodation available at Green Cottage Chamarel (“the Property”) is offered as a tourist residence subject to confirmation by Raymond Lagesse (“the Owner”) to the renter (“the Client”).

2. CONDITIONS

The following conditions together with the general information contained in our website and/or various platform form the basis of your contract with the Owner, however property details and /or room facilities may be different from the photos and therefore invite you to check with us any specifies that may be important to you. The Property is provided in “as is “condition, prices include water, electricity, gas, internet access, internet TV, fireplace, supply and laundry of bed linen and towels as well as usage of the premises, including parking area. These conditions set out our respective rights and conditions.

3. CHECK-IN / CHECK-OUT

Our check in is from 16.00Hrs and our check out is before 09.00Hrs. The Property shall be for the exclusive use of the guest (the Client) and only available to the guest (the Client) and the number of persons indicated at time of the booking confirmation, subletting or sharing with may be allowed, only on demand to the Owner, if approved the authorised additional guests should not be more than 6 on the premises, including the Client. Visitors will be considered as guests, if their stay are longer than 6 hours, a charge of Rs 2500 per individual will be claimed by the Owner and payment to be made by the booking renter (the Client).

4. USE OF PROPERTY

The Client agrees to be a considerate tenant and use the Property responsible while taking good care of the Property, furniture, fittings & all amenities as describe in the Inventory List and on departure it must be left clean and all tidy, all furniture positioned at their original place, in the same state of cleanliness as found on arrival. Any damage caused, the Owner reserve the right to claim to the Client. Any behaviour contrary to laws, good morals and/or public order will result in the Owner asking the guest (the Client) to leave the premises. In such a case, neither compensation nor refund shall be made by the host (the Owner). The host (the Owner) shall also not be responsible for any damages or prejudice if any, this will be applied automatically and as of right, without the host (the Owner) having to fulfil any judicial or extra judicial formality.

Children must be under constant adult supervision as the Property does not have child security systems or supervision.

The Client accepts that a ‘No Smoking’ policy inside the property is in operation.

Animals, including pets and strays, are not permitted.

The Client will be required to present a valid passport or NID at time of check-in.

Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. Guest and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbours, nor shall Guest use the Property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property.

5. PAYMENT / CONFIRMATION

A full payment is required to be paid on confirmation, if made directly via bank transfer, please ensure the payment is net of charges, or as per agreed terms of payment of the booking platform.

6. CANCELLATION

In case a cancellation is requested, the following will apply:

  • Up to 14 days prior arrival: No cancellation fee, your payment will be refunded.
  • As from 14 days prior to arrival: Your payment will retain at your disposal for a re-schedule stay, in case of “Force Majeure”, an official proof will have to be submitted.
  • If in the Property, due to cyclonic conditions (Class 3), your payment will be refunded pro-rata for unused days.
  • No show or unexpected departures: 100% of payment will be kept.

All price listed on our website are in MUR.

In case of flight delay, cancellation extension or due to unforeseen circumstances (including cyclones) the whole stay will be charges with no refund or claim pro-rata for extra night.

7. DEFECT REPORT

The Client shall report to the Owner without delay any defects in the Property or breakdown in the equipment, plant, machinery or appliances in the Property and grounds. The Owner will arrange for repair and/or replacement as practicably possible will be made as soon as possible. Any breakage damaged by the Client to any one of the items of the inventory list will be claimed by the Owner.

8. TROPICAL FRIENDS

The Property is located in a tropical and forest location. Bugs, rodents, ants, lizards, cockroaches and others pets are part of the environment and are endemic to the area.

Professional services are hired to provide pest and animal control for inside and outside of the Property.

The mattresses and pillows are treated regularly, for your additional comfort, we provide insects sprays, should the Client be sensitive, we recommend that you close all doors and windows for extra precaution or bring your own repellent.

You must contact the Owner to report any issues that may arise during your stay and agree to allow us to remediate the problem as practicable possible.

If we agree that you must vacate the Property, you will only be entitled to a pro-rata refund for half the unused days only.

9. LIABILITY / LIMITATION / RISK

The Owner shall not be liable to the Client:

  • LIMITATION
    Under no circumstances shall the Owner’s liability to the Client exceed the amount paid in respect of the rental period.
    Whilst every effort has been made to ensure that the details provided are accurate, the representations and details shall not give rise to any liability on the part of the Owner. Every effort will be made to notify any changes in the details prior to the commencement of the holiday.
  • RISK
    Guest acknowledges that use of amenities such as fireplace, barbecue and the light may be potentially dangerous and involve potential risks, if improperly used, particularly with regard to children and such use is at the Guest’s own risk.
  • DEFAULT
    If Guest should fail to comply with the conditions and obligations of this Agreement, Guest shall surrender the Property, remove all Guest’s property and belongings and leave the Property in good order and free of damage. No refund of any portion of the Total Rental Fee shall be made and if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.
  • RISK OF LOSS AND INDEMNIFICATION
    Guest agrees that all personal property, furnishings, personal affects and other items brought into the Property by Guest or their permitted guests and visitors shall be at the sole risk of Guest with regard to any theft, damage, destruction or other loss and Rental Agent shall not be responsible or liable for any reason whatsoever.
  • RELEASE
    Guest hereby waives and releases any claims against Rental Agent, the Property owner and their successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by Guest on or near or adjacent to the Property, including any common facilities, activities or amenities. Guest agrees to use any such facilities or amenities entirely at the Guest’s own initiative, risk and responsibility.
  • ENTRY AND INSPECTION
    Rental Agent reserves the right to enter the Property at reasonable times and with reasonable advance notice for the purposes of inspecting the Property or showing the Property to prospective purchasers, renters or other authorized persons. If Rental Agent has a reasonable belief that there is imminent danger to any person or property, Rental Agent may enter the Property without advance notice.
  • JURISDICTION
    This contract shall be governed by Mauritius law in every particular including formation and interpretation and shall be deemed to have been made in Mauritius. Any proceedings arising out of or in connection with this contract may be brought in any court of competent jurisdiction in Mauritius. By residing at Green Cottage Chamarel, the Client is in agreement with the terms and conditions.

10. RULES & RESPONSIBILITIES

The following rules and responsibilities shall be applicable:
In staying on the Property, the client agrees to follow and abide to all rules and conditions as listed.

  1. No visitors are allowed, except with the permission of The Host.
  2. The villa is rented for the number of people indicated at the time of booking. In case of over-occupancy, The Host will charge Rs 2,500 / night / extra person payable in MUR upon check-in. The maximum occupancy of the property is 6 guests. Occupancy over 6 guests will not be allowed.
  3. Young children should be under the constant supervision of adults.
  4. You are fully responsible for taking care of all personal belongings and valuables. We recommend you make use of the safe placed in each bedroom. We cannot be held responsible in case of loss.
  5. Please do not assign and/or delegate one or more of your rights and/or obligations under the booking of this villa rental.
  6. Avoid causing noise pollution that would in any way disturb the peace of neighbours. The property has a zero-tolerance policy for noise. Loud music & parties are strictly forbidden.
  7. Avoid any act or oversight that could cause damage to the premises or result in the nullity or voidability of the insurance policy of the premises. Access to “technical” items, in general, is not allowed.
  8. Fireworks are strictly prohibited
  9. Authorise property personnel, housekeeping, and gardening team, to enter the premises during reasonable hours for standard operation intervention, and for inspection.
  10. Please take care of the premises, as it was your own, by keeping the interior & exterior areas in order and in good condition.
  11. Smoking – we request the use of outdoor spaces for smoking. Kindly make use of ashtrays for cigarette buds and take all necessary precautions and safety measures to prevent fire for your own personal safety. Smoking in the bedrooms is strictly forbidden.
  12. A period of 2 hours is granted to the guest, after taking possession of the villa, to report any error on the arrival inventory. After that period, the premises are deemed to have been delivered in perfect condition.
  13. Restore any damage caused to the premises by accepting to reimburse the cost of replacement or of repair.
  14. Usage of candles can be a real hazard if not monitored correctly. Please keep the lighted candles out of the reach of kids. Light up candles in an area free of any inflammable items such as curtains, napkins, or furniture.
  15. Please do not use the property for any other purpose than that of holiday accommodation. Any other use must be approved by the Owner in advance.
  16. If the premises were left in poor condition and additional cleaning is required, a fee of Rs 2,000 will be claimed and will be payable upon check-out.
  17. Animals are prohibited in the cottage.
  18. All illegal substances, drugs, arms, or any other type of dangerous objects and substances are prohibited on the property.
  19. Make sure you understand how to use any electrical equipment that you are not familiar with and please do not change any existing settings. Please do not move or remove appliances, dishes, bedding, or other equipment.
  20. In case of personal injury, you should always contact your own insurance company. The Host cannot be held responsible for this process.
  21. Protect our environment by saving Water & Energy. Please turn off the water, electrical equipment & lights after use and use the resources in an eco-conscious way.
  22. Please do not hang wet towels or clothes on balconies, balustrades & furniture.

11. CHANGING TOWELS AND LINENS
